Employers May Be Required to File Form 1095-B

What You Should Know

Affordable Care ActEmployers who are exempt from the employer mandate, under the Affordable Care Act, (less than 50 FTE employees) may be required to file Form 1095-B.  This form reports health insurance information for the employees to the IRS.

Form 1095-B, Health Coverage, is issued by employers offering health coverage. This includes small employers which are exempt from the employer mandate but opt to offer coverage anyway.

Exceptions To The Rule

The form usually is not required for medical flexible spend accounts (FSAs), health reimbursement accounts (HRAs), or in some cases health savings accounts (HSAs), because these plans do not offer minimum essential coverage.

Do Your Research

Employers should research the instructions to Form 1095-B and be prepared to file if necessary.
